Terms of Service

These Terms of Service ("Terms") govern your access to and use of Platform28, LLC's ("Platform28," "we," "us," or "our") website, products, and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Platform28 provides cloud-based contact center software and related services, including but not limited to:

  • Omnichannel communication tools
  • AI-powered customer service automation
  • Call routing and management
  • Analytics and reporting
  • Workforce management tools

Specific features and functionality are governed by your service agreement with Platform28.

3. Account Registration

To access certain features of our services, you may need to create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Transmit malicious software or harmful code
  • Interfere with the operation of our services
  • Engage in unauthorized data collection or scraping
  • Harass, abuse, or harm others
  • Send unsolicited communications in violation of applicable laws

5. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned by Platform28 or our licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on our services without our express written permission.

6. Data and Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

You are responsible for ensuring that your use of our services complies with all applicable data protection laws and regulations.

7. Service Availability

We strive to provide reliable service with 99.999% uptime. However, we do not guarantee uninterrupted access to our services. We may:

  • Perform scheduled maintenance with reasonable notice
  • Suspend services for security or emergency reasons
  • Modify or discontinue features with reasonable notice

Service level commitments are specified in your service agreement.

8. Payment Terms

If you subscribe to paid services, you agree to pay all fees according to your service agreement. Fees are non-refundable except as specified in your agreement or required by law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLATFORM28 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of our services shall not exceed the amounts paid by you to Platform28 in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Platform28 and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

11. Termination

We may suspend or terminate your access to our services at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use our services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless otherwise specified in your service agreement.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
